Terms and Conditions for Automotive Repair Services

This document outlines the terms and conditions governing automotive repair, maintenance, diagnostic, customer communication, appointment, and related services provided by Marin Auto Works, hereinafter referred to as “the Shop”.

 

1. Service Agreement

 

By engaging the services of the Shop, requesting an appointment, approving an estimate, leaving a vehicle with the Shop, or otherwise authorizing work, the customer agrees to the terms and conditions outlined herein.

 

2. Estimates

 

All cost estimates provided by the Shop are based on the initial assessment of the vehicle’s condition and the information available at the time of inspection.

 

Actual costs may vary depending on the extent of repairs needed, parts availability, labor requirements, diagnostic findings, and additional issues discovered during service.

 

The customer will be informed of any material changes in cost before the commencement of additional work requiring separate approval.

 

3. Authorization

 

The customer authorizes the Shop to perform the repairs, diagnostics, maintenance, inspections, or other services agreed upon by the customer and the Shop.

 

Any additional work not covered by the initial estimate will require separate customer authorization before that work is performed.

 

Authorization may be provided in person, by phone, by email, by text message, through an online approval system, or by another method accepted by the Shop.

 

4. Parts and Materials

 

The Shop may use new, used, remanufactured, original equipment manufacturer, or aftermarket parts as appropriate for the repair, depending on availability, customer preference, vehicle requirements, and the nature of the service.

 

All replaced parts will be retained by the Shop unless the customer requests the return of replaced parts before the work is completed, subject to any legal, warranty, core, or supplier restrictions.

 

5. Payment Terms

 

Payment for services is due upon completion of repairs or services, unless otherwise agreed in writing.

 

The Shop accepts cash, credit cards, debit cards, checks, and other payment methods accepted by the Shop.

 

Vehicles may not be released until payment is made in full.

 

Invoices not paid within the specified timeframe may be subject to late fees, storage fees, collection action, or other remedies permitted by law.

 

All vehicles are subject to a storage fee of $20 per business day beginning 72 hours after repairs are completed and the invoice remains unpaid, unless otherwise required or restricted by applicable law.

 

6. Warranty

 

All repairs will be performed in accordance with the customer’s authorization and in compliance with California Bureau of Automotive Repair (BAR) regulations. Parts removed during service will be made available for inspection upon request at the time of vehicle delivery, unless subject to warranty or exchange. All new replacement parts will be warranted by the part manufacturer, and labor will be warranted for 12 months or 12,000 miles, whichever comes first, unless otherwise specified in writing. Used, rebuilt, or aftermarket parts may carry different warranty terms. Payment in full will be due upon completion of service. We are not responsible for loss or damage to vehicles or articles left in vehicles in case of fire, theft, or any other cause beyond our control. The customer may authorize additional repairs beyond the original estimate. If desired, the customer may approve a maximum overage amount in advance. No additional work will be performed without customer authorization, except as permitted by written pre-approval documented on this estimate. By reviewing and accepting this estimate, the customer consents to receive future communications, including final invoices and authorizations, via phone, email, or text message.   

 

7. Customer Responsibilities

 

The customer is responsible for providing accurate and complete information about the vehicle’s condition, symptoms, service history, prior repairs, warning lights, known issues, and any relevant circumstances.

 

The Shop is not responsible for delays, misdiagnosis, additional costs, or repair issues resulting from incomplete, inaccurate, or withheld information provided by the customer.

 

The customer is also responsible for removing valuables, personal items, and sensitive property from the vehicle before leaving it with the Shop.

 

8. Personal Property

 

The Shop is not responsible for loss of or damage to personal items left in the vehicle during inspection, repair, maintenance, storage, or service.

 

Customers are advised to remove all valuables and personal property before leaving the vehicle with the Shop.

 

9. Delays

 

The Shop will make reasonable efforts to complete repairs within the estimated timeframe.

 

However, delays may occur due to parts availability, supplier delays, diagnostic complexity, technician availability, additional problems discovered during service, insurance or warranty approval delays, or other unforeseen circumstances.

 

The customer will be notified of significant delays when reasonably possible.

 

10. Diagnostic Services

 

Diagnostic fees may apply when the Shop performs testing, inspection, troubleshooting, or evaluation to identify a vehicle issue.

 

Diagnostic fees cover the time, labor, tools, and expertise required to investigate the issue. Diagnostic fees may apply regardless of whether the customer approves the recommended repairs.

 

11. Customer-Supplied Parts

 

The Shop may, at its discretion, decline to install customer-supplied parts.

 

If the Shop agrees to install customer-supplied parts, the Shop does not warrant the quality, fitment, performance, or durability of those parts.

 

Labor charges may still apply if customer-supplied parts are defective, incorrect, incomplete, or fail after installation.

 

12. Vehicle Storage and Abandoned Vehicles

 

Customers must pick up vehicles promptly after being notified that work is complete.

 

Vehicles left unpaid or unclaimed may be subject to storage fees, lien procedures, or other remedies permitted by applicable law.

 

13. SMS and Customer Communications

 

Marin Auto Works may communicate with customers by phone, email, and SMS text message regarding appointments, service requests, repair updates, estimates, approvals, missed-call follow-up, review requests, and customer support.

 

Customers who provide a mobile phone number and opt in to receive SMS messages agree to receive service-related text messages from Marin Auto Works.

 

Message frequency varies. Message and data rates may apply.

 

Consent to receive SMS messages is not required as a condition of purchasing any goods or services.

 

Customers may opt out of SMS messages at any time by replying STOP. Customers may reply HELP for help.

 

No mobile information, SMS consent, or text messaging opt-in data will be shared with third parties or affiliates for marketing or promotional purposes.

 

14. Limitation of Liability

 

The Shop is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of use, loss of income, loss of business, inconvenience, or substitute transportation costs, except where prohibited by applicable law.

 

The Shop’s liability for any claim related to services performed shall not exceed the amount paid by the customer for the specific service giving rise to the claim, except where prohibited by applicable law.

 

15. Dispute Resolution

 

Any disputes arising from these terms and conditions or services provided by the Shop will first be addressed through good-faith discussion between the customer and the Shop.

 

If the dispute cannot be resolved informally, the parties agree to pursue mediation or arbitration in accordance with applicable local laws, unless otherwise prohibited by law.

 

16. website Use

 

The Marin Auto Works website is intended for customers seeking information about automotive repair services, appointment requests, service inquiries, and customer communication. Users agree not to misuse the website, attempt unauthorized access, interfere with website operation, submit false information, or use the website for unlawful purposes.

 

Website Content and Intellectual Property

 

All content on the Marin Auto Works website, including text, logos, images, graphics, service descriptions, and other materials, is owned by or licensed to Marin Auto Works unless otherwise stated. Users may not copy, reproduce, modify, distribute, or use website content without prior written permission.

 

Changes to Services and Website

 

Marin Auto Works may update, modify, suspend, or discontinue website features, service offerings, pricing, policies, or these Terms and Conditions at any time. Updates will be posted on this page with a revised “Last updated” date.

 

Website Availability

 

Marin Auto Works makes reasonable efforts to keep the website available and accurate, but does not guarantee that the website will always be uninterrupted, error-free, secure, or current.


 

17. Changes to These Terms
